Regulations of the online store

§ 1

Introductory Provisions

The Witexshop online store available at www.witexshop.com is run by Witex sp. z.o.o. with its registered office in Radom, entered into the National Court Register by the District Court in Warsaw, 14th Commercial Division of the National Court Register under the number KRS 0000506751 with share capital of PLN 40,000.00, NIP 948-260-11-38, REGON 147220555.

These Regulations are addressed to both Consumers and Entrepreneurs using the Store and define the rules for using the Online Store as well as the rules and procedure for concluding Sales Agreements with the Customer at a distance via the Store.

§ 2

Definitions

Consumer - a natural person concluding a contract with the Seller as part of the Store, the subject of which is not directly related to its business or professional activity.

Seller - Witex sp.z.o.o. with headquarters in Radom at ul. Przemysłowa 15, postal code 26-615 entered into the National Court Register by the District Court in Warsaw, XIV Commercial Division of the National Court Register under KRS number 0000506751 with share capital of PLN 40,000.00, NIP 948-260-11-38, REGON 147220555

Entrepreneur - a natural person, a legal person and an organizational unit that is not a legal person, the separate law of which grants legal capacity, performing on its own behalf an economic activity that uses the Store.

Store - an online store run by the Seller at the Internet address www.witexshop.com

Distance contract - contract concluded with the Customer as part of an organized system of concluding distance contracts (as part of the Store), without the simultaneous physical presence of the parties, with the sole use of one or more means of distance communication up to and including the conclusion of the contract.

Regulations - these Store regulations.

Order - the Customer's declaration of will submitted via the Order Form and aimed directly at concluding the Product Sales Agreement or Products with the Seller.

Account - customer account in the Store, it contains data provided by the customer and information about orders placed by him in the store.

Registration form - a form available in the Store that allows you to create an Account.

Order form - an interactive form available in the Store that allows you to place an Order, in particular by adding Products to the Cart and defining the terms of the Sales Agreement, including the method of delivery and payment.

Shopping Cart - an element of the Store's software, in which the Products selected for purchase are visible, and it is also possible to determine and modify the Order data, in particular the quantity of products.

Product - a movable item / service available in the Store which is the subject of the Sale between the Customers and the Seller.

Sales Agreement - a Product sales contract concluded or concluded between the Customer and the Seller via the Online Store. The Sales Agreement also means - in accordance with the features of the Product - a contract for the provision of services and a contract for specific work.

Offer - a method of concluding a contract as defined in the Civil Code, consisting in the submission of a declaration of will by the tenderer.

Price - includes VAT.

§ 4

Technical requirements

Conditions that must be met by the customer to use the online store:

1. Computer, Internet access, Internet browser and enabled cookies.
2. An active e-mail account.

§ 5

General information

1. The Seller is not responsible for any disruptions, including interruptions in the functioning of the Store, caused by force majeure
2. Viewing the Store's assortment does not require creating an Account.
3. Placing orders is possible only after creating a customer account or providing personal data
4. The purchase price is the price of the product plus shipping
5. The colors in the photos in the store may differ from the real ones

Creating an Account in the Store

1. To create an Account in the Store, you must complete the Registration Form;
2. Creating an Account in the Store is free

§ 7

Rules for placing an Order

1. Log in to the Store (optional);
2. Select the Product that is the subject of the Order, and then click the "Add to Cart" button.
3. Log in or use the option of placing an Order without registration
4. If you have chosen to place an Order without registration - fill in the Order Form by entering the details of the recipient of the Order, telephone number and the address to which we will deliver the Product, select the type of shipment (Product delivery method), enter the invoice data, if different from the recipient's details
5. click „Go to payment an delivery”
6. Choose a payment method
7. Click „Finalize the order”

Delivery and payment methods

1. The Customer may use the following methods of delivery of the ordered Product:

a. Courier delivery

§ 9

Execution of the sales contract

1. The conclusion of the Sales Agreement takes place after the consumer has placed the Order on the website of the online store www.witexshop.com. Order method: completed order form.
2. After placing the Order, the Seller immediately confirms its receipt and accepts the Order for execution.
3. Confirmation of receipt of the Order and acceptance for implementation is generated by the witexshop.com platform in an e-mail to the one provided when placing the Order. The e-mail is a confirmation of the conclusion of the Sales Agreement between the Customer and the Seller.
4. The customer is obliged to make the payment within 3 calendar days from the date of the Sale Agreement, otherwise the order will be canceled.
5. The product will be sent by the Seller within the time specified in its description.
6. The beginning of the date of delivery of the Product to the Customer is consistent with the date of receipt of the payment on the Seller's account
7. Delivery of goods to the customer is chargeable.
8. Product delivery costs are included in the Delivery tab and when placing the Order.
9. Companies with a European Tax Identification Number will be invoiced in accordance with the provisions of the Act on Intra-Community Trade, pursuant to Art. 196 of the VAT Directive,

§ 10

Personal data in the Online Store

The administrator of personal data provided by the Consumer when using the Store is the Seller. The seller applies the rules contained in The General Data Protection Regulation (EU) 2016/69

1.The processing of personal data by the Seller is necessary to handle the Customer's orders. We will process personal data in the following cases:

a.a sales contract or actions taken at the request of the Buyer, aimed at its conclusion,

b. the seller has a legal obligation related to accounting,

c. the legitimate interest of the Seller, consisting in the processing of data in order to establish, assert or defend any claims

2.Failure to provide the data will prevent the conclusion of a sales contract in the Store.

3.Customer data provided in connection with purchases in the Store will be processed until:

a. the sales contract concluded between the Buyer and the Seller is no longer valid,

b. the Seller will no longer be bound by the legal obligation to process the Buyer's data

c. the possibility of pursuing claims by the Buyer or the Seller related to the sales contract concluded by the Store will cease,

d. Customer's objection to the processing of his personal data is accepted.

4.The customer has the right to request:

a. access to your personal data,

b. rectifying them,

c. removal,

d. completion of processing,

§ 11

Final Provisions

1. Agreements concluded by the Online Store are in English.
2. The Seller reserves the right to amend the Regulations for important reasons, that is:

• changes in the law,
• changes in payment and delivery methods,

In matters not covered by these Regulations, generally applicable provisions of Polish law shall apply.
